TERMS AND CONDITIONS

These Terms & Conditions outline the terms under which Pixel Equipt provides design, digital, branding, social media, and related creative services.
By requesting, purchasing, or approving any service provided by Pixel Equipt, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1. SERVICES
Pixel Equipt provides a range of creative, digital, branding, and design services, which may include, but are not limited to:

Pixel Equipt may also accept custom design projects that are not specifically listed above. The scope, deliverables, pricing, and timeline for each project will be discussed and agreed upon before work begins.
2. PROJECT SCOPE & QUOTATIONS
Each project will be quoted according to the services requested, the complexity of the project, the amount of work involved, and the agreed deliverables.
A quotation or proposal will outline the agreed scope of work where applicable.
Work that falls outside the original agreed scope may result in additional charges. Any additional work or services will be discussed with the client before the additional work is undertaken.
3. PAYMENT
For projects requiring a deposit, a 50% deposit is required before work begins, unless otherwise agreed in writing.
The remaining 50% balance is due upon completion and prior to final delivery, publication, transfer, or handover of the completed project.
For smaller design services, including individual flyers, menus, CVs, cards, banners, presentations, and similar projects, full payment may be required before work begins, depending on the project.
Pixel Equipt reserves the right to pause work or withhold final files, website access, editable files, or other deliverables until outstanding payments have been received.
4. REVISIONS & CHANGES
Unless otherwise agreed, projects include two rounds of revisions.
A revision refers to reasonable changes to the agreed design or content.
Requests that substantially change the original brief, require a new concept, introduce new content, or require significant redesign may be considered additional work and may incur an additional fee.
Additional revisions beyond those included in the agreed package will be quoted according to the scope of the requested changes.
5. CLIENT CONTENT & RESPONSIBILITIES
The client is responsible for providing all information and materials required to complete their project, including where applicable:

Business information

Menu items and prices

CV/resume information

Any other materials required for the project
The client is responsible for ensuring that all content supplied to Pixel Equipt is accurate, authorised for use, and does not infringe the intellectual property or copyright of another person or organisation.
Pixel Equipt is not responsible for errors, inaccuracies, copyright infringement, or legal issues arising from content supplied by the client.
6. APPROVALS
Clients are responsible for carefully reviewing designs, content, spelling, pricing, contact information, links, images, and other details before approving a project.
Once a design has been approved by the client, Pixel Equipt will not be responsible for errors that were present in the approved version.
Changes requested after final approval may incur an additional fee.
7. PROJECT TIMELINES
Project timelines will be discussed and agreed upon before work begins.
Timelines depend on the scope of the project, the client's responsiveness, the availability of required content, and the number of revisions required.
Delays in providing information, content, feedback, approvals, or payment may result in the project completion date being extended.
Pixel Equipt will make reasonable efforts to complete projects within the agreed timeframe but cannot guarantee a specific completion date where delays occur outside of Pixel Equipt's control.
8. WEBSITE DESIGN & HANDOVER
For website projects, the agreed design fee covers the website design and services specifically included in the quotation.
Unless otherwise agreed, the following are not included in the website design fee:

Premium third-party applications

Paid plugins or integrations

Subscription services

Payment gateway fees

Booking system fees

Other third-party platform costs
Once the website has been completed and the final payment has been received, ownership and agreed access to the website will be transferred to the client.
After handover, ongoing website management, maintenance, updates, content changes, and troubleshooting are the client's responsibility unless an ongoing maintenance service has been purchased.
Pixel Equipt may offer ongoing website maintenance or updates at an additional fee.
9. WEBSITE HOSTING & DOMAIN
Domain registration and hosting costs are the responsibility of the client unless specifically included in the agreed package.
The client is responsible for maintaining their domain and hosting subscriptions and ensuring that renewals are paid on time.
Pixel Equipt is not responsible for website downtime, domain expiry, hosting issues, server problems, or other issues caused by third-party hosting or domain providers.
10. THIRD-PARTY SERVICES & INTEGRATIONS
Some projects may require third-party platforms, applications, plugins, subscriptions, or services.
These may include, but are not limited to:

Booking systems

Email services
-
Website applications

Social media platforms
-
Google services
-
Hosting providers
-
Domain providers

Other external software or platforms
Any third-party fees are the client's responsibility unless explicitly included in the quotation.
Pixel Equipt is not responsible for changes, outages, restrictions, pricing changes, technical failures, or discontinuation of third-party services.
11. SOCIAL MEDIA MANAGEMENT
Where social media management is purchased, the specific platforms, number of posts, content requirements, posting frequency, services, and duration will be agreed upon separately.
The client is responsible for providing accurate business information, promotions, pricing, offers, photographs, and other relevant information where required.
Pixel Equipt is not responsible for changes to social media algorithms, platform restrictions, account suspensions, reduced reach, technical issues, or other circumstances outside of Pixel Equipt's control.
Unless specifically included in the agreed package, community management, replying to comments, responding to direct messages, and customer service are not included.
12. GOOGLE BUSINESS PROFILE
Where Google Business Profile services are provided, Pixel Equipt may assist with setup, optimisation, information, visuals, and related profile content as agreed.
Pixel Equipt does not guarantee specific Google rankings, search positions, reviews, traffic, enquiries, or business results.
Google controls its own search algorithms, policies, verification processes, rankings, and platform functionality.
13. DESIGN FILES & EDITABLE FILES
Unless specifically included in the agreed package, Pixel Equipt generally provides the final agreed deliverables in suitable formats for their intended use.
Editable/source files, working files, templates, design files, or other production files are not automatically includedunless specifically agreed.
Where editable files are requested after completion, an additional fee may apply.
14. OWNERSHIP & USAGE RIGHTS
Once full payment has been received, the client receives the agreed rights to use the final approved design for its intended purpose.
Pixel Equipt retains ownership of its working files, design processes, concepts that were not selected, and unused design directions unless otherwise agreed in writing.
Third-party fonts, photographs, graphics, templates, stock assets, software, or other licensed materials remain subject to their respective licensing terms.
15. PORTFOLIO & MARKETING USE
Unless otherwise agreed, Pixel Equipt reserves the right to display completed work in its portfolio, website, social media, marketing materials, and other promotional channels.
If a client requires a project to remain confidential or not be displayed publicly, this must be discussed and agreed upon before or during the project.
16. CANCELLATION
If a client cancels a project before work has commenced, any refund will be considered based on the circumstances of the cancellation and work already performed.
Once work has commenced, the deposit or payments made may be retained to compensate Pixel Equipt for time, work, planning, resources, and services already provided.
If a project is cancelled after significant work has been completed, the client may be responsible for payment for work completed up to the date of cancellation.
17. REFUNDS
Due to the personalised and digital nature of Pixel Equipt's services, payments are generally non-refundable once work has commenced.
Each refund request will be considered based on the circumstances of the project and the work already completed.
Where a refund is agreed upon, the amount refunded may be reduced to account for work, services, resources, or expenses already provided or incurred.
18. CLIENT INACTIVITY
If a client becomes unresponsive for an extended period of time, Pixel Equipt may pause or close the project.
Where possible, the client will be contacted before a project is closed.
If the client wishes to resume a project after an extended period of inactivity, additional fees or a revised timeline may apply.
19. CONFIDENTIALITY
Both Pixel Equipt and the client agree to treat confidential business, project, personal, and payment information shared during the course of a project as confidential.
Information that is already publicly available or becomes publicly available through no fault of either party will not be considered confidential.
20. LIMITATION OF LIABILITY
Pixel Equipt will make reasonable efforts to provide professional and reliable services.
However, Pixel Equipt is not responsible for losses, delays, interruptions, technical failures, platform changes, server downtime, third-party service failures, social media restrictions, website hosting issues, or other circumstances outside of its reasonable control.
Pixel Equipt is also not responsible for business losses, lost revenue, loss of data, loss of customers, or other indirect losses resulting from the use or performance of a website, design, social media account, marketing material, or other service provided.
21. FORCE MAJEURE
Pixel Equipt will not be held responsible for delays or failure to perform its services due to circumstances beyond reasonable control, including technical failures, internet or power outages, illness, natural disasters, platform outages, third-party service failures, or other unforeseen circumstances.
22. COMMUNICATION
Project communication, feedback, approvals, and important decisions should be provided through the agreed communication channel.
Clients are responsible for checking communications relating to their project and responding within a reasonable timeframe where their input is required.
23. AGREEMENT
By making payment, approving a quotation, requesting work to begin, or otherwise proceeding with a project, the client confirms that they have had the opportunity to review these Terms & Conditions and agree to be bound by them.
These Terms & Conditions apply to all Pixel Equipt services unless specific alternative terms have been agreed upon in writing.
